We have extensive environmental litigation experience including representation of clients in complex, multi-party cost recovery actions, as well as in more limited cost recovery actions involving successive property owners and operators and/or adjoining property owners. We have also litigated complex land use matters. Our extensive environmental remediation and redevelopment experience encompasses representation in complex administrative enforcement matters, and voluntary cleanups of large and small Brownfields sites and hazardous waste disposal sites under both federal and state agency oversight. We have worked closely with clients, brokers and insurers in procuring and manuscripting cost cap insurance policies for cleanups and in administering and recovering costs under such policies. We also assist clients in obtaining site closures from regulatory agencies and the recovery of qualified site cleanup costs from the California UST Fund. The firm handles all aspects of CERCLA, the federal Superfund statute, including responding to natural resource damage claims by federal and state trustees.

Edgcomb Law Group counsels clients with the environmental aspects of real estate transactions, including pre-purchase assessment and investigation of commercial properties (“due diligence” investigations) and the allocation of environmental liabilities by contract terms and with environmental liability insurance.

The Firm provides compliance advice on various environmental laws, including those governing the treatment, storage and disposal of hazardous waste and the transportation of hazardous materials and wastes, as well as negotiation of administrative penalties assessed for alleged violations of such laws and regulations.
